Workers’ Compensation Attorney

New Jersey has some of the hardest workers in the nation.

But some jobs are more dangerous than others, and certain jobs can sometimes lead to pretty serious injuries.

The good news is that you may be entitled to workers’ compensation benefits to pay for your injury related medical bills and receive money to make ends meet. The bad news is that the insurance company may have not offered these benefits, or may be actively trying to prevent you from getting what you’re owed.

When you’re in this situation, you might find yourself with a number of questions: How will I pay for my medical treatment? How can I pay my bills? Will I be fired?

Attorney Craig Voorhees is a fierce advocate for New Jersey workers, and his 20 years of experience puts him in a unique position to advocate for your rights and benefits.

“Craig is very astute, and an honorable man and attorney. My case was past the statute of limitations for Workers’ Compensation by 15 days, but Craig was very diligent, and never wavered. He stuck to his guns and got me what we both feel as a fair and honest settlement. He has your best interests in mind. Thank you Craig. You did right by me.”

How Workers’ Compensation works

The first thing you should know about workers’ compensation is that it is a no-fault system without a determination of liability. This means that you should receive benefits if you’re injured on the job, in most circumstances.

These injuries can include:
  • Traumatic accidents or injuries at work
  • Repetitive strain/stress injuries that develop from your work

To start your workers’ compensation claim process, you need to report the injury to your employer. Your employer should then contact their workers’ compensation insurance company which will assign an adjuster to look into your claim. Many times, unfortunately, adjusters find reasons to deny your claim.

But just because the insurance company says something doesn’t mean they’re right. Even if your claim is denied, you still have the right to take your case to workers’ compensation court.

Benefits Included in Workers’ Compensation

Before you get started on your workers’ compensation claim, you might want to have an idea of the types of benefits you can receive.

Here’s what New Jersey cases include:
  • Medical Treatment for the injuries caused by the work accident, although the law gives employers/insurance carriers the right to choose the healthcare provider
  • Temporary Total Disability Benefits covering 70% of your weekly wage subject to a cap set by law for a maximum of 400 weeks
  • Permanent Partial Disability Benefits (monetary payments) when the injury causes permanent residuals impairing function of the affected body part(s)
  • Permanent Total Disability Benefit when you are unable to return to work in any capacity due to your work-related injuries. These weekly payments continue for life so long as you remain totally and permanently disabled
  • Death Benefits are weekly payments that go to the survivors in the case a worker has died due to an accident/illness

Workers’ Compensation Claims vs. Third-Party Liability Claims

When you bring your case to Voorhees Law Offices, we take a look at all the details of your injury. We check to see whether your accident is covered for benefits and whether we need to look into a third-party liability claim.

Here’s how it works:
  • Workers’ compensation claim – You file a claim petition with the workers’ compensation court to pursue all the benefits you are entitled by law
  • Third-party liability claim – You can’t file a personal injury lawsuit against your employer, except in extremely limited circumstances, but if you believe someone other than your employer is responsible for your injury, you still have options. You can also pursue a liability claim against a third party who you believe is responsible for your illness or injury by proving their fault.
